These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and Multi Mailbox ("Company," "we," "us," or "our"), governing your access to and use of the services provided through the website multimailbox.com and any related applications or services (collectively, the "Service").

1. Introduction and Agreement

1.1. Acceptance of Terms

By accessing or using the Service, you signify your unreserved agreement to be bound by these Terms and all terms incorporated herein by reference. If you do not agree to all of these Terms, you are expressly prohibited from using the Service.

1.2. Modifications

Multi Mailbox reserves the right, at its sole discretion, to modify or revise these Terms at any time. All changes are effective immediately when we post them and apply to all access to and use of the Service thereafter. Your continued use of the Service following the posting of revised Terms signifies your acceptance of the changes.

2. Service Provision

2.1. Description of Services

Multi Mailbox provides a service that facilitates the management of multiple email accounts, offers alias creation, and enables enhanced email organization and delivery. The specific features and functionalities of the Service may be updated or modified periodically at our discretion.

2.2. Service Availability

While Multi Mailbox endeavors to ensure the Service is available consistently, we do not guarantee uninterrupted or error-free access. The Service may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic communications. We are not responsible for any delays, delivery failures, or other damage resulting from such problems.

3. User Responsibilities and Conduct

3.1. Account Registration

To access certain features of the Service, you may be required to register for an account. You warrant that all information provided during registration is accurate, current, and complete. You agree to maintain and promptly update your account information to keep it accurate, current, and complete.

3.2. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Service by, any third party.

3.2.1. Prohibited Actions

You are expressly prohibited from:

  • (a) Transmitting any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.

  • (c) Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
  • (d) Uploading, posting, emailing, or otherwise transmitting any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
  • (e) Interfering with or disrupting the Service or servers or networks connected to the Service.
  • (f) Attempting to gain unauthorized access to any portion of the Service, other accounts, computer systems, or networks connected to the Service.
  • (g) Violating any applicable local, state, national, or international law, including, but not limited to, laws and regulations governing email and electronic communications.

3.2.2. Compliance with Laws

You are solely responsible for compliance with all laws, rules, and regulations applicable to your use of the Service.

3.3. Security of Account

You are solely responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account. You agree to notify Multi Mailbox immediately of any unauthorized use of your account or any other breach of security.

4. Intellectual Property Rights

4.1. Multi Mailbox Property

All intellectual property rights in the Service, including but not limited to, all text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork, and computer code (collectively, "Content"), including but not limited to the design, structure, selection, coordination, expression, "look and feel," and arrangement of such Content, contained on the Service is owned, controlled, or licensed by or to Multi Mailbox, and is protected by copyright, patent, and trademark laws, and various other intellectual property rights and unfair competition laws.

4.2. User Content

You retain all ownership rights to any content you submit, post, or display on or through the Service ("User Content"). By submitting User Content, you grant Multi Mailbox a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such User Content in any and all media or distribution methods (now known or later developed) as necessary to provide the Service to you.

5. Disclaimers and Limitation of Liability

5.1. No Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. MULTI MAILBOX DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

5.2. Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MULTI MAILBOX, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE. IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF MULTI MAILBOX EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING OR USING THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO SUCH LIABILITY.

5.3. Indemnification

You agree to defend, indemnify, and hold harmless Multi Mailbox, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

6. Termination of Service

6.1. Termination by User

You may terminate your account and discontinue your use of the Service at any time by following the instructions within your account settings or by contacting us at [email protected].

6.2. Termination by Multi Mailbox

Multi Mailbox may terminate or suspend your account and access to the Service immediately, without prior notice or liability, if you breach any provision of these Terms. We may also terminate or suspend your account for any other reason, or no reason, at our sole discretion.

6.3. Effect of Termination

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability, shall survive termination.

7. General Provisions

7.1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Multi Mailbox is incorporated, without regard to its conflict of law provisions.

7.2. Entire Agreement

These Terms constitute the entire agreement between you and Multi Mailbox regarding the use of the Service, superseding any prior agreements between you and Multi Mailbox relating to your use of the Service.

7.3. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
